Terms of Service

These Terms of Service ("Terms") are an agreement between you and Smirnov Labs, LLC, a Colorado limited liability company ("we", "us"), that governs your use of Onward — the website and web app at onward.smirnovlabs.com, our mobile apps, and the Model Context Protocol (MCP) interface (together, the "Service").

In short: Onward is a personal habit tracker offered free of charge and "as is". You own the habit data you create, you're responsible for your account and how you share, and there are limits on our liability. Please read the full terms below.

1. Acceptance of these terms

By creating an account or otherwise accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.

2. Who may use Onward

You must be at least 13 years old (or 16 in the European Economic Area) and able to form a binding contract to use the Service. If you use Onward on behalf of an organization, you represent that you are authorized to accept these Terms for it.

Most features require an account, which you create with an email and password or by signing in with Google or Apple. You are responsible for keeping your credentials secure and for all activity that happens under your account. Notify us promptly at [email protected] if you believe your account has been compromised.

You keep all rights to the habits, records, and other content you create in Onward ("Your Content"). You grant us a limited, non-exclusive, worldwide license to host, store, process, and display Your Content solely to operate and provide the Service to you and the people or apps you choose to share it with. You are responsible for Your Content and for having the rights necessary to store it.

Signing in with Google or Apple and any apps you connect are provided by third parties under their own terms and privacy policies. We are not responsible for third-party services and do not endorse them.

Onward is currently provided free of charge. If we introduce paid features in the future, we will present the applicable terms and obtain your agreement before you incur any charge.

9. Availability and changes to the Service

We provide the Service on an "as available" basis. We may add, change, suspend, or discontinue features, and we may perform maintenance, at any time and without liability. We work to keep Onward reliable but do not guarantee that it will be uninterrupted or error-free.

10. Intellectual property

Onward, including its name, logo, design, and software, is owned by Smirnov Labs and protected by applicable laws. These Terms do not transfer any of our intellectual property to you; you receive only a limited right to use the Service in accordance with these Terms.

11. Not professional advice; disclaimers

Onward is a personal habit-tracking tool. It does not provide medical, psychological, health, financial, legal, or other professional advice, and any insights or analyses it produces are informational only. To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of liability

To the maximum extent permitted by law, Smirnov Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the Service. To the extent liability cannot be excluded, our total liability for any claim is limited to the greater of the amount you paid us for the Service in the twelve months before the claim (which may be zero) or fifty U.S. dollars (US$50).

You agree to indemnify and hold Smirnov Labs harmless from any claims, damages, and expenses (including reasonable legal fees) arising out of your misuse of the Service, Your Content, or your violation of these Terms.

14. Termination

You may stop using Onward and delete your account at any time. We may suspend or terminate your access if you violate these Terms or misuse the Service. When your access ends, your right to use the Service stops, and the sections that by their nature should survive — including content ownership, disclaimers, limitation of liability, and indemnification — continue to apply.

15. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above, and for material changes we will provide a more prominent notice. Your continued use of the Service after an update means you accept the revised Terms.

16. Governing law

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Colorado for any dispute not resolved informally.
